Terms of Service

Welcome to Art Whisper. By downloading, installing, or using the Art Whisper application ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
Art Whisper is operated by Bright Star, a company registered in the State of Israel ("we", "us", "our", "Art Whisper").
1. About the App
Art Whisper is a museum companion app that helps you identify artworks by taking photos with your device camera or by uploading existing photos from your device. The App uses artificial intelligence and image recognition to match your photos against our database of artworks, artists, and art movements.
2. Eligibility
You must be at least 13 years old to use Art Whisper. By using the App, you confirm that you meet this requirement.
For users in the European Economic Area, the United Kingdom, or other jurisdictions where the digital age of consent is above 13, users under that local age may use Art Whisper only with the consent of a parent or guardian.
In-app purchases by minors must be made with parental authorization, including through Apple's Family Sharing with Ask to Buy or Google's Family Library.
3. Definitions
For the purposes of these Terms:
- "Account" means a unique user account created through the authentication methods supported by the Service.
- "Service" means the Art Whisper application and related online services.
- "Scan" means a single successful identification of an artwork by the Service. A Scan is "successful" only when the Service returns an identification of the artwork to the user, based on an internal confidence threshold determined by the Service, which may be adjusted from time to time. Where the Service is unable to identify the artwork and indicates so to the user, no Scan is deducted from the Scan Balance. The Scan definition applies identically whether the photo was taken with the device camera or uploaded from the device.
- "Free Scans" means the complimentary Scans granted upon Account creation.
- "Scan Pack" means a one-time, consumable in-app purchase that adds Scans to your Scan Balance.
- "Scan Balance" means your total available Scans at any time, comprising Free Scans and any Scans added via Scan Packs.
4. Your Account
When you create an Account using the authentication methods supported by the Service, you are responsible for keeping your login credentials secure and for all activity under your Account. If you suspect unauthorized access, contact us immediately at support@artwhisper.app.
You may delete your Account at any time from the Settings screen. Upon deletion, your profile and collections are permanently removed within 30 days. Scan history is de-identified and retained for service improvement, as described in our Privacy Policy.
Each individual is permitted one Account. Creating multiple Accounts to obtain additional Free Scans or to circumvent any limit constitutes a breach of these Terms. Bright Star may, at its discretion, suspend, merge, or terminate duplicate or fraudulent Accounts, and may forfeit any Free Scans or unused Scan Balance associated with such Accounts.
5. License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. This license does not allow you to:
- Copy, modify, or distribute the App or any part of it
- Reverse-engineer, decompile, or disassemble the App
- Use the App for any commercial purpose without our written permission
- Remove or alter any proprietary notices in the App
6. Free Scans
Upon creation of a new Account, we will credit your Scan Balance with fifteen (15) Free Scans. Free Scans:
- are granted once per Account and once per individual;
- have no cash value and are not refundable, exchangeable, or transferable;
- do not expire so long as the Account remains active and the Service remains available;
- are not restored upon Account deletion and re-registration;
- may be revoked in the event of breach of these Terms, fraud, or abuse;
- are provided as a promotional courtesy, not as contractual consideration, and do not constitute an entitlement to continued operation of the Service.
7. Scan Packs (In-App Purchases)
Scan Packs are one-time, consumable in-app purchases offered through the Apple App Store or Google Play Store at the prices displayed in the application. Pricing is subject to local taxes, currency conversion, and platform pricing tiers, and may vary by region or change from time to time.
All purchases of Scan Packs are processed by Apple Inc. or Google LLC, as applicable, and are subject to the terms of service and payment policies of the applicable platform. Bright Star does not directly process payments, store payment card information, or act as the merchant of record for in-app purchases.
Upon successful purchase and validation by the applicable platform, the purchased Scans will be credited to your Scan Balance.
Scan Balance is deducted only upon a successful Scan. Attempts to scan or upload artwork that do not result in an identification, and Service errors or technical failures preventing identification, do not deduct from the Scan Balance. When a Scan is initiated and your Account has both Free Scans and purchased Scans available, Free Scans will be consumed first.
Scans, Scan Packs, and Free Scans:
- are licenses to use the Service and not property of the user;
- have no monetary value outside the Service;
- cannot be sold, transferred, gifted, or exchanged for cash or credit;
- cannot be combined or transferred between Accounts;
- do not expire so long as the Account remains active and the Service remains available.
8. Refunds
All refund requests for Scan Pack purchases must be directed to Apple or Google, as applicable, in accordance with their respective refund policies. Bright Star does not have the technical or commercial ability to refund in-app purchases.
In the event Apple or Google grants a refund, the corresponding Scans will be deducted from your Scan Balance. If the refunded Scans exceed your remaining Scan Balance, the deficit may be deducted from any Scans subsequently added to the Account.
Consumed Scans are non-refundable. Scans consumed prior to a refund being granted will be considered services rendered.
In the event the Service is permanently discontinued, unused paid Scans may be eligible for a pro-rata refund where required by applicable law, including the Israeli Consumer Protection Law 5741-1981 and the EU Consumer Rights Directive 2011/83/EU.
Notwithstanding the above, where mandatory consumer protection laws confer cancellation or refund rights that cannot be contractually waived, those rights apply.
9. Suspension and Termination
We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if required for legal, security, or operational reasons.
- Termination for cause (breach of Terms, fraud, abuse): your unused Scan Balance is forfeited.
- Termination not for cause: unused paid Scans may be eligible for pro-rata refund where required by applicable consumer protection law.
Upon termination, your license to use the App ends immediately. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will continue to apply.
10. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Upload content that is harmful, offensive, or infringes on the rights of others
- Upload photos that you do not have the right to use, or that infringe the intellectual property, privacy, or other rights of any third party
- Attempt to gain unauthorized access to our servers or systems
- Interfere with or disrupt the App or its infrastructure
- Use automated tools (bots, scrapers, scripts, emulators) to access the App or obtain Scans
- Misrepresent your identity or impersonate others
- Use the App to collect data about other users
- Use the App to develop or train competing services
- Create multiple Accounts to obtain additional Free Scans or circumvent Scan Balance limitations
- Resell, gift, or transfer Scans
- Reverse-engineer the in-app purchase receipt validation flow
- Otherwise engage in conduct that is fraudulent, abusive, or inconsistent with normal use
We may limit the number of Scan attempts within a given period to maintain Service quality and prevent abuse.
11. AI and Content Disclaimer
Art Whisper uses artificial intelligence to identify artworks. AI-generated results are not guaranteed to be accurate. The App may misidentify artworks, provide incorrect information about artists or art movements, or fail to recognize an artwork entirely.
The determination of whether a Scan attempt has resulted in a successful identification is made automatically by the Service based on its internal confidence threshold. This threshold may be adjusted from time to time as the Service is improved.
We do not guarantee the accuracy, completeness, or reliability of any content in the App, whether generated by AI or sourced from our database. Information may contain errors regardless of its source.
You should not rely on Art Whisper as the sole source of information about any artwork. The information provided is for educational and entertainment purposes only and must not be used for artwork authentication, valuation, provenance verification, legal proceedings, or any purpose requiring professional expertise.
We are not responsible for decisions you make based on information provided by the App.
12. Intellectual Property
Our content
The App, including its design, code, features, and branding, is owned by Bright Star and protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
Artwork information
The artwork data, artist biographies, and art movement descriptions displayed in the App are compiled from public sources and our own research. This content is provided for informational purposes and may be subject to third-party rights. We do not claim ownership of third-party artworks and make no representations regarding their copyright or licensing status.
Your content
Photos you take with the App or upload to the App remain yours. By using the scan or upload feature, you grant us a limited, non-exclusive, worldwide license to process the photos for the purpose of artwork identification and related Service functionality. Our handling of scanned and uploaded photos, including retention of unrecognized photos for service improvement, is described in our Privacy Policy.
By uploading a photo to the App, you represent and warrant that:
- you have the right to upload the photo, including any necessary permissions from the photographer, copyright holder, or any other rights holder;
- the upload does not infringe the intellectual property, privacy, or other rights of any third party;
- the upload does not violate any applicable museum or venue photography policies that may apply to you; and
- the upload does not contain content that is unlawful, harmful, harassing, defamatory, or otherwise inappropriate.
You are solely responsible for the content of photos you upload. We reserve the right to refuse to process, retain, or store any uploaded content at our discretion.
13. Third-Party Services
The App relies on third-party service providers for authentication, AI image processing, hosting, analytics, error monitoring, transactional email, and payment processing (through the Apple App Store and Google Play Store). Your use of these underlying services may be subject to their respective terms and privacy policies. The categories of service providers we use are described in our Privacy Policy. We are not responsible for the practices of third-party service providers.
14. iOS-Specific Terms
For users of the App on iOS devices: your use of the App is also subject to Apple's Standard End User License Agreement, available at apple.com/legal. In the event of any conflict between these Terms and Apple's Standard EULA, these Terms govern to the extent permitted by Apple's developer requirements.
You acknowledge that:
- these Terms are between you and Bright Star only, and not with Apple Inc.;
- Apple is a third-party beneficiary of these Terms and may enforce them against you;
- Bright Star, not Apple, is solely responsible for the App and its content, including providing maintenance, support, and addressing any product or third-party intellectual property claims.
15. Availability and Changes
The App is an evolving product. We strive to keep the App available but do not guarantee uninterrupted access. We may:
- Modify, update, or discontinue features at any time, subject to providing pro-rata refund for unused paid Scans where required by applicable consumer protection law
- Perform maintenance that temporarily limits availability
- Change these Terms with reasonable notice through the App or our website
Continued use of the App after non-material changes to these Terms constitutes acceptance of the updated Terms.
16. Limitation of Liability
To the maximum extent permitted by law:
- The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement
- We do not warrant that the App will be error-free, secure, or uninterrupted
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
- Our total liability for any claim related to the App shall not exceed the greater of 100 ILS or the amount you paid us in the 12 months preceding the claim
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for fraud or willful misconduct.
17. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Bright Star from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms, your misuse of the App, or your upload of content that infringes the rights of any third party.
18. Dispute Resolution
If you have a dispute with us, we encourage you to contact us first at support@artwhisper.app so we can try to resolve it informally. We commit to responding within 30 days.
If we cannot resolve the dispute informally, it shall be submitted to the exclusive jurisdiction of the competent courts in Tel Aviv, Israel.
Notwithstanding the foregoing, EU consumers retain the right to bring proceedings in their country of residence and to benefit from mandatory consumer protections under the law of their residence, as provided under Regulation (EU) 1215/2012 (Brussels I bis) and Regulation (EC) 593/2008 (Rome I). UK consumers retain analogous rights under UK law. Consumers in Israel retain rights under the Israeli Consumer Protection Law 5741-1981 that cannot be contractually waived.
19. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles. This choice of law does not affect rights that are protected under mandatory provisions of the law of the consumer's country of residence that cannot be derogated from by agreement.
20. Force Majeure
We are not liable for any delay or failure to perform our obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, infrastructure failures, or government actions.
21. Assignment
We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, sale of assets, or by operation of law. You may not assign your rights under these Terms without our prior written consent.
22. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
23. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bright Star regarding your use of the App. For iOS users, Apple's Standard End User License Agreement (as referenced in Section 14) also applies.
